Article 1 — Definitions

In these terms: "Mobisun": Mobisun B.V., based in Amersfoort, registered with the Chamber of Commerce (KvK) under 68972849; "Customer": the natural or legal person entering into an agreement with Mobisun; "Products": all goods offered by Mobisun, including power stations, solar panels, bundles and accessories.

Article 2 — Applicability

These general terms apply to all offers, quotes and agreements between Mobisun and the customer. Deviations from these terms are only valid if agreed in writing.

Article 3 — Offers and prices

All offers on shop.mobisun.com are without obligation and valid while stocks last. Prices are in euros and include VAT, excluding shipping costs unless otherwise stated. Typographical and printing errors are not binding.

Article 4 — Conclusion of agreement

The agreement is concluded when the customer places an order via the website and Mobisun confirms it by email. For B2B orders (quotes), the agreement is only concluded after written approval by both parties.

Article 5 — Right of withdrawal (consumers)

The consumer has the right to withdraw from the agreement within 14 calendar days (generously extended by Mobisun to 30 days) without giving reasons, in accordance with Title 5, Book 6 of the Dutch Civil Code. Article 6 — Delivery

Mobisun delivers orders within 1-3 business days within the Netherlands, 2-5 business days within the EU, and 5-15 business days elsewhere. Delivery times are indicative and give the consumer no right to compensation for damages in case of delay. If a product is not available, Mobisun will notify the customer within 7 days.

Article 7 — Payment

The customer pays the amounts due before or upon delivery, via the payment methods offered on the website. In case of late payment, the customer is in default after a reminder and Mobisun may charge statutory interest and collection costs.

Article 8 — Retention of title

All delivered products remain the property of Mobisun until the full purchase price, including any interest and costs, has been paid by the customer.

Article 9 — Warranty and conformity

Mobisun guarantees the conformity of the delivered products in accordance with art. 7:17 of the Dutch Civil Code. Additionally, Mobisun offers 2-year warranty on all products on top of the legal conformity expectation. Article 10 — Liability

Mobisun is not liable for indirect damage, including consequential damage, loss of profit or data loss. Liability is limited to the amount of the relevant order, except in case of intent or gross negligence.

Article 11 — Privacy

Mobisun processes personal data in accordance with the GDPR. See our <a href="/pages/privacy-policy-nl" style="color:var(--color-yellow);font-weight:600;text-decoration:underline">privacy policy</a> for details.

Article 12 — Disputes

Dutch law applies to all agreements. Disputes are submitted to the competent court in Amersfoort, without prejudice to the legal options for the consumer to submit a dispute to the <a href="https://www.degeschillencommissie.nl" style="color:var(--color-yellow);font-weight:600;text-decoration:underline">Disputes Committee</a> or the European ODR platform (<a href="https://ec.europa.eu/consumers/odr" style="color:var(--color-yellow);font-weight:600;text-decoration:underline">ec.europa.eu/consumers/odr</a>).
